Snow and Ice Removal
Per City Ordinance, all snow and ice shall be removed from the sidewalk within twelve (12) hours after the snow has ceased falling and/or the ice has accumulated.
Possible Fines:
A) The owner, agent or any other person having the care of any building or lot of land bordering on any public way within the city shall cause all snow and ice, however accumulated, to be removed from the footway, sidewalk or byway (if laid out such by the city) within twelve (12) hours after the snow has ceased falling and/or the ice has accumulated. However if the if the snow ceases falling or the ice accumulates during the nighttime, the same shall be removed during the immediatly succeeding daylight hours. A clearing of all snow in a path along the sidewalk frontage of the property at least equal to one-half the width of the sidewalk is required here under.
B) Code Enforcement Inspectors and Police Officers, are all hereby designated enforcing persons of Section 17-4 of the Code, and upon viewing a violation of this section, either directly or upon receipt of a complaint, shall inform such violator that such snow or ice must be removed, in accordance with this section, and shall reinspect the premises within twenty-four (24) hours to determine if the snow and ice were removed; otherwise, a complaint shall be applied for at the district court forthwith. The penalty for violation of this section shall be one hundred ($100.00) for each occurence.
C) Notwithstanding the criminal penalties under subsection (b) above, violations of Section 17-4 of the Code may, as an alternative, in the discretion of the enforcing person(s), be the subject matter of Non Criminal Disposition under Mass. General Laws Chapter 40, ยง21 D and Section 1-16 of the Code, as amended.
