When a Permit is Required
A permit is required to install a swimming pool. The
State Building Code defines a swimming pool as any structure that contains water over 24 inches (610 millimeters) in depth and which is used, or intended to be used, for swimming or recreational bathing. This includes self-install or inflatable temporary pools.
A swimming pool must be set back a minimum of 5 feet to the water line from the side and rear property lines and at least 10 feet from the dwelling.
When Fencing is Required
A fence must be installed that is at least 4 feet high (for a residential pool), with a self-closing and self-latching gate. If the wall of the house serves as part of the enclosure, any doors leading from the house to the pool must be alarmed.
